FAQs
The Most Common Questions
Legal funding is an advance on money you’re expecting to receive from a personal injury settlement or an approved case we fund. We can get you money right away so that you don’t have to wait to pay your bills.
Legal funding is also referred to as litigation finance or pre-settlement funding.
It’s fairly common for a victim to call us before they hire an attorney. We can still help. We can provide you with a list of attorneys in your area that are already familiar with legal funding and specifically our process so that we can help you get your case started.
However, we are not attorneys and cannot provide funding unless an attorney has been retained for your personal injury case.
If you’ve already retained an attorney, we simply we need to know if you were at fault. Aside from basic contact info about yourself and the case, such as date, location and extent of your injuries, we can get the rest of the information from your attorney.
It’s simple. It’s easy.
- Call and apply. Provide your information along with your attorney’s.
- We contact your attorney and ask a few questions about your case to understand where the case stands.
- We make an offer, then electronically send out contracts to sign by you and your attorney.
- Once contracts are signed, we send funding directly to you via Western Union.
Getting Approved For Funding
Your credit history is never considered, nor is a credit report ever obtained in considering if you qualify for funding.
Once we get the information we need to approve your case for funding, we can get you cash within 24 hours. The time it takes to get information from your attorney is also a factor.
Our funding limits are typically set at 10% of your expected settlement amount. For example, if you’re expecting to receive a $100,000 settlement, we can approve qualified cases up to $10,000 for the duration of your settlement. 800CaseCash promotes responsible funding practices, which means we may recommend or in some cases require you to take only what you need now so that we may assist you in having access to funding when you need it most. Taking a large sum upfront can result in a higher pay off once the settlement is finalized.
800CaseCash is very proud of our “Best Rate Guarantee” – which means, you can look, but you won’t find better rates than hours. If you do find a lower rate, send us the written offer. We won’t be offended. We’ll just beat it.
We told you we’ve made funding a simple and quick process. Repayment is even easier. You simply do not have to worry about it. Your attorney will repay what you owe when you receive your settlement.
If you don’t win your case, you don’t owe us any money. Plain and simple. That said, understand that funding your case not only removes financial stress, but should also build confidence that we believe in your case that we’re willing to take that risk for our clients!
After You Call To Apply
As soon as we end our call, you should call your attorney right away to inform them of your application with us so that they can be expecting our call. Attorneys get lots of calls, all day, everyday. Informing them of what you need and explaining what you need it for is always recommendation so that when we contact them, they are aware we will be calling. This can also give your attorney time to prepare the information we need from them.
Keep in mind your attorney was retained to protect you, so you should expect him/or her to be protective of you and the interest of your case.
There is no need to say anything other than what you are actually doing. Simple inform your attorney that you just applied for legal funding and mention 800CaseCash as the company you applied to and that’s it!
There is technically no waiting period to reapply, however, we do require that your case has progressed in some way since the previous funding. (Examples include: a medical procedure or examination has been completed, a wage loss claim is now submitted. We don’t have a specific requirement on what we’re looking for, we just need to show the case is beyond our last review.)
There are many reason why a client can get denied funding, however, most commonly is no response from your attorney and/or incomplete paperwork. Keep in mind, may times, a denial can simply mean, more information needs to be known about your case. Once that information becomes available, we can reopen your application.
Absolutely not. 800CaseCash believes it can in most cases help victim’s avoid the pressure of accepting a lowball settlement. If we can help victims get access to cash, then we believe that will eventually lead to higher settlement amounts for those victims as well as shorter lengths of personal injury cases.
Insurance companies can be slow in responding or they could also delay the process by sending out adjusters or requiring second opinions on medical procedures or exams. The worse your injury, the more diligence you need to allow your attorney to do. That’s very difficult if not impossible if you struggle to buy food and pay bills. Legal funding, done responsibly can also remove pressure from attorneys who don’t need to be distracted. Their work requires long hours and careful concentration.
